Can a Person Drive for Uber & Lyft With a Bad Driving Record?

Get a Free Consultation

Uber and Lyft provide convenient transportation throughout Wisconsin. Passengers expect that the person behind the wheel is a safe and responsible driver. Unfortunately, not everyone who applies to drive for a rideshare company has a spotless driving history.

A person with a bad driving record may still qualify to drive for Uber or Lyft in Wisconsin. It all depends on the number, severity, and timing of their violations. However, Wisconsin law prohibits rideshare companies from hiring drivers with certain offenses. For example, multiple recent traffic violations and some serious driving-related convictions can disqualify a driver.

Understanding these restrictions can help passengers recognize potential safety concerns and their legal options after an accident.

What Are Wisconsin’s Driving Record Requirements for Uber and Lyft?

Wisconsin regulates rideshare companies. Under Wisconsin law, rideshare companies must review an applicant’s driving history. Companies must also perform a criminal background check before approving a driver.

The law prohibits companies from allowing certain individuals to drive, including those who have:

  • More than three moving violations within the previous three years
  • A conviction within three years for certain serious traffic offenses
  • Qualifying impaired-driving offenses within the previous 7 years
  • Certain serious criminal convictions within the previous 7 years
  • An invalid driver’s license or insufficient proof of insurance

Drivers must also meet Wisconsin’s minimum age requirement of 19.

These restrictions establish minimum legal standards. Rideshare companies may adopt additional screening requirements.

Can Someone Drive for Uber or Lyft With a DUI?

A recent conviction for operating while intoxicated (OWI) can prevent someone from becoming a rideshare driver.

Wisconsin disqualifies applicants who committed certain impaired-driving offenses within the previous 7 years. Both Uber and Lyft review applicants for alcohol-related and drug-related driving violations.

However, an older conviction does not necessarily result in permanent disqualification. Eligibility depends on the offense, applicable laws, and the company’s screening policies.

A driver with a suspended or revoked license cannot legally qualify to transport rideshare passengers.

Does Uber or Lyft Check Driving Records Regularly?

Yes. Both companies conduct background checks before approving new drivers. Additionally, Uber and Lyft continue to monitor driving records. A driver who qualifies initially but later receives multiple traffic citations may lose eligibility.

Wisconsin law also requires participating drivers to notify their rideshare company immediately after being convicted of a moving violation, felony, or misdemeanor. These requirements help identify potentially unsafe drivers. However, background checks and monitoring cannot prevent every accident.

What Happens if an Uber or Lyft Driver Causes an Accident?

When an Uber or Lyft driver causes an accident, their actions and driving history may be relevant to determining liability. Previous violations alone do not establish negligence, but a history of speeding, reckless driving, or impaired driving may be considered. Investigators may also examine whether the rideshare company complied with applicable driver screening requirements.

Injured passengers, pedestrians, and other motorists may be entitled to compensation for medical expenses, lost wages, pain and suffering, and other losses. Available insurance coverage may depend on whether the driver was waiting for a ride request or transporting a passenger.

Reviewing driving records, evidence, and rideshare trip information can help determine liability and identify applicable insurance coverage.
