A Madison woman was injured in a car crash. She obtained a policy limit settlement of $50,000 from the fault driver. Eisenberg Law Offices, S.C. then commenced an action against the woman’s underinsured motorist carrier. The UIM carrier’s first offer was $6,750. After reviewing that information, the UIM carrier agreed to pay the policy limits $200,000.
August 2024 – Settlement of $650,000
A 7 year old girl was injured on a school playground when another 7 year old pushed her off playground equipment. She sustained a broken elbow. Eisenberg Law Offices, S.C. sued the homeowner’s insurance carrier of the 7 year old boy. The parties settled for $650,000.
August 2024 – UTV Crash Policy Limit Settlement of $175,000
A woman was injured in a UTV crash in which her significant other died. The parties settled with the bodily injury insurer for the policy limits of $100,000. The significant other had an accidental death life insurance policy. The insurance company refused to pay arguing there was an exclusion in the policy that prevented payment. Eisenberg Law Offices, S.C. convinced the life insurance company that the exclusion was invalid and that payment was due. The life insurance company ultimately paid the entire life insurance benefits available of $75,000.
August 2024 – Car Crash Policy Limit Settlement of $1,300,000
A Dodgeville man was driving at highway speeds when another car failed to stop at a stop sign and struck the man’s work vehicle. The man sustained no broken bones and was not hospitalized, but developed chronic pain as a result of the crash. The insurance company offered $350,000. After obtaining permanency reports from the man’s treating physicians, the parties ultimately settled for the policy limits of $1.3 million.
June 2024 – Car Crash Policy Limit Settlement of $300,000
A Florida man working in Wisconsin was injured in a car crash. The insurance company first offered $130,000,00. The case ultimately settled for the policy limits of $300,000.00.

January 2024 – Policy Limit Settlement of $150,000
A Wisconsin Rapids man was injured by an off-duty deputy sheriff. Despite the fact that the investigating agency was the off-duty deputy sheriff’s own department and concluded that the client was at fault, Eisenberg Law Offices, S.C. investigated the case and determined that the deputies of the sheriff’s department that investigated the case were biased and provided false information as to how the crash occurred. Eisenberg Law Offices, S.C. was able to show that the crash was actually the fault of the off-duty police officer. The parties settled for the $150,000 policy limits of the insurer of the off-duty police officer.

A Sauk City woman was a passenger in a motor vehicle being driven by her husband when another vehicle failed to stop at a stop sign and collided with our client’s vehicle. A Mequon man’s vehicle was rear ended by another driver. The parties settled for the $250,000 policy limits of the at-fault driver.
August 2023 – Policy Limit Settlement of $300,000
A Madison woman’s car was rear ended by another vehicle. She sustained injuries, including a rotator cuff tear. The parties settled for the policy limits of the at-fault driver of $100,000 and an additional $200,000 from the client’s insurance policy that provided underinsured motorist coverage.

A Madison woman was rear ended by another motor vehicle. Her physical injuries were minimal but she sustained hearing loss as a result of the loud noise of the crash and the deployment of the air bags. Eisenberg Law Offices, S.C. hired and audiologist who conducted hearing tests on the woman and determined that she sustained significant hearing loss in one ear as a result of the crash. The insurance company for the at-fault driver paid its policy limits of $250,000.
November 2022 – Golf Car Crash Settlement of $450,000
A Madison woman was killed after falling from a golf cart. The woman’s automobile insurance company paid out its $300,000 uninsured motorist policy limits. The driver of the golf cart alleged that his dog may have contributed to the woman falling out of the golf cart. Eisenberg Law Offices, S.C. was able to obtain an additional $150,000 policy limit settlement from the driver’s homeowner’s insurance alleging strict liability for the owner of the dog in contributing to the fall from the golf cart.
July 2022 – $420,000 Car Crash Settlement
A 71-year-old man was injured on Highway Q in the Town of Westport when another vehicle failed to stop at an intersection. The insurance company for the at-fault driver argued that the client’s neck injury was pre-existing. Eisenberg Law Offices obtained expert opinions from an orthopedic surgeon and a neurosurgeon to confirm that the neck injury was sustained in the car crash. The insurance company’s original offer was $15,000. The parties eventually settled for $420,000.
May 2022 – $250,000 Policy Limit Car Crash Settlement
A Madison man was injured when another driver failed to yield the right-of-way on University Avenue in Middleton, causing a collision. The client did not contact Eisenberg Law Offices until 2-1/2 years after the crash. Nevertheless, Eisenberg Law Offices was able to obtain a policy limit settlement of $250,000 for the neck and back pain suffered in the accident.

A Brodhead man was attacked by another dog while he was walking his dog. The man sustained injuries to his hand. Eisenberg Law Offices obtained a settlement of $225,000 against the homeowner’s insurance of the dog owner.
October 2021 – $200,000 Car Crash Settlement
A Madison woman was injured on East Washington Avenue when another vehicle failed to stop at a stop sign and caused a collision. The other driver was not insured. Eisenberg Law Offices commenced a lawsuit against the UM carrier for our client. The UM carrier failed to pay the policy limits of $100,000 in a timely manner. The client then filed a bad faith claim against the insurer. The insurer ended up settling for $200,000, twice the insurer’s policy limits as a result of the bad faith claim.
September 2021 – $150,000 Car Crash Settlement
A Pardeeville woman was injured in a car crash when another driver failed to yield the right- of-way at an intersection. The woman sustained a mild non-displaced fracture of the hip which healed without any residual pain or discomfort. The parties settled for $150,000.
September 2021 – $1,000,000 Policy Limit Settlement
An elderly gentlemen was being transported for medical care when the vehicle in which he was riding was struck by another vehicle causing it to roll over. The man sustained significant injuries. The parties settled with the at fault driver for the policy limits of $50,000 and then obtained the UIM policy limits of $950,000, for a total settlement of $1,000,000.
August 2021 – $400,000 Car Crash Settlement
A Columbus man was injured on the interstate when another vehicle negligently struck his vehicle from behind. The parties settled for $400,000. Eisenberg Law Offices first obtained the $250,000 policy limits from the at-fault driver and an additional $150,000 from the client’s UIM carrier.
June 2021 – $200,000 Campground Trampoline Settlement
A minor child broke her leg on a trampoline at a campground near the Wisconsin Dells. Eisenberg Law Offices obtained a $200,000 settlement from the campground for her injuries.

A 25-year-old woman was injured on Highway 39 near Windsor, Wisconsin, when another vehicle lost control and swerved into her, propelling her vehicle into a ditch. A Jefferson County man was injured in a car crash when another vehicle failed to yield the right-of-way at an intersection. Because the case settled for the policy limits of $300,000, Eisenberg Law Offices was able to obtain a waiver of all subrogation liens, which totaled in excess of $80,000.

A Madison woman was injured in a low-impact crash when she was traveling in a cross walk and a vehicle struck her causing injuries to her lower back and left leg. A man was seriously injured when he was hit by another vehicle while riding his motorcycle. The man settled with the at-fault driver for the policy limits of $100,000, as well as an additional $150,000 of policy limits on the man’s UIM insurance policy. Eisenberg Law Offices, S.C. resolved the case for the policy limits within six months of the injury.
October 2020 – $1,315,000 Policy Limit Settlement
A Beloit man was seriously injured following a hit and run crash on State Highway 67. The at-fault driver had no insurance, but was charged with numerous criminal offenses. Eisenberg Law Offices obtained the policy limits of the client’s uninsured motorist policy. The parties were able to resolve the case within five months of the car crash which provided much needed funds for the care of the injured client. Eisenberg Law Offices was further able to have all hospital liens and other subrogation healthcare expenses waived as a result of the policy limit settlement. The injured party did not have to reimburse any healthcare provider.
September 2020 – $825,000 Policy Limit Settlement for Fatal Crash
A young man from West Bend was tragically killed in a car crash caused by a drunk driver. The parties settled for the $100,000 policy limits of the at-fault driver, an additional $500,000 from the at fault’s driver grandmother who provided alcohol to the underage drunk driver, and another $225,000 from the family’s UIM insurance, for a total policy limit settlement of $825,000.
August 2020 – $295,000 Settlement for Car Crash
A Mount Horeb man was injured when he was struck by a vehicle that failed to stop at an intersection. The crashed caused an exacerbation of the man’s preexisting neck pain. He accrued $36,000 in medical expenses. The parties settled for the $100,000 policy limits of the at-fault driver and received an additional $195,000 from the UIM carrier.

A Stoughton, WI woman was hit by a drunk driver in 2016. Eisenberg Law Offices, S.C. obtained a settlement for the policy limits of $100,000.00 against the drunk driver’s insurance company and then proceeded against the client’s insurance company on her underinsured motorist coverage. The most significant injury was to her knee, which required arthroscopic surgery. The client incurred medical expenses of $54,000.00 and lost wages of $16,000.00. In December, 2014, a Waunakee, WI woman was exiting the beltline onto Gammon Road in Madison, Wisconsin. Her vehicle was stopped when another driver, traveling approximately 15 mph, rear-ended her vehicle. Approximately one month before the crash, our client had surgery on her lower back. The client recovered remarkably well from that surgery and was almost pain free. The December, 2014, motor vehicle crash exacerbated her significantly improved low back pain. As a result of the crash, our client required periodic medial branch blocks and radiofrequency ablations with a pain management physician. The driver braked hard for another car while in traffic, resulting in the client being propelled out of her wheelchair. The client sustained a broken ankle which subsequently healed. The client had medical expenses of $60,000.00. Stephen J. Eisenberg and Eisenberg Law Offices, S.C. settled the case with the insurer for the medical transport vehicle for $175,000.00 in November, 2018.

A Madison, Wisconsin, man was walking in a parking lot after leaving a sports bar. Another driver backed out of his parking stall and literally ran over the client’s foot. Settlement Of $357,000 For Fall Down Stairs – October 2017
On February 17, 2016, a Portage woman was visiting her sister when she fell down a stairway leading to the basement of her sister’s apartment. The landlord haphazardly installed shower towel bar tubes instead of staircase railings. The railings were not continuous, nor did they meet building code requirements. Attorney Stephen J. Eisenberg retained a building code expert who inspected the premises and determined that the stairway and handrail system on the home was designed and installed in an extremely defective and poor manner. The building code expert concluded that the handrails were installed in violation of the Uniform Dwelling and Building Code. The 67 year-old woman sustained a left broken ankle, right broken wrist, and a right rotator cuff tear, all of which required surgery. Attorney Stephen J. Eisenberg settled the claim with American Family in October, 2017, for $357,000. The client’s medical expenses totaled $122,000.

On March 12, 2017, a Madison man was traveling southbound on Highway Y when another vehicle rear-ended his vehicle. The 80 year old man sustained fractures to his mid back, as well as broken ribs. In December, 2017, Attorney Stephen J. Eisenberg settled a claim with a medical device implant provider for $290,000. An Eau Claire man underwent a left total knee arthroplasty, or knee replacement, in 2014. The implanted knee did not provide any bone ingrowth on the tibial component resulting in a defective implant. The implant device was later recalled by the medical device provider. The client underwent a subsequent knee revision surgery to install a new knee implant. The client sustained $40,000 of lost wages. Medical expenses were approximately $100,000. The client recovered from the revision surgery well. The case was settled with the medical device provider for $290,000 without a trial.

A Stoughton woman and her brother from Las Vegas were injured when they were hit head-on by a drunk driver near the Dane County Regional Airport in September, 2014. Both brother and sister suffered severe injuries and were hospitalized for 7-10 days, followed by rehabilitation in an assisted living center. A DeForest man was injured in a car accident when his vehicle was “T-boned” at an intersection after a 16-year-old girl negligently failed to stop at a stop sign. A Madison man was injured while riding his bicycle in a crosswalk in Madison when he had to swerve to avoid a car that was about to hit him. The bicyclist and the car did not collide. However, as a result of swerving, the bicyclist fell over and fractured his hip. After a 3-day trial in Dane County Circuit Court, a jury awarded the bicyclist $294,500.00 for lost wages, pain and suffering and medical expenses as a result of a fractured femoral head which required surgery.
